Orange County Police Officers and Firearms Defense Lawyer

Helping Law Enforcement Agents Recover Their Firearms

Any type of domestic violence charge carries the potential for many serious penalties such as imprisonment, probation and fines. In California, another important penalty is the loss of your right to own a gun. Under California law, any felony offense involves a lifetime ban on possessing a firearm. Certain misdemeanors, including domestic violence misdemeanors, result in a 10-year ban on possessing a firearm. If you are a police officer or in law enforcement, the inability to carry a firearm can be catastrophic.

If you are a peace officer, or if your livelihood depends on the ability to carry a firearm, there are often exceptions to this rule. A defense attorney can help you find out whether you qualify. The Law Offices of David P. Schwarz has helped numerous police officers with domestic violence convictions regain their right to bear arms. Contact us to learn more.

We Know the Law and How to Help You

Under California law, peace officers can ask the court for relief from the firearm ban in certain circumstances. To begin, this request can only be made after you complete your probation, and can only be made one time. Further, the conviction must be to a misdemeanor, and not to a felony. If you have already asked a court for relief from the firearm ban, you cannot do so again. This must be your only such conviction, and you must show by a preponderance of the evidence that you are "likely to use a firearm in a safe and lawful manner." Criminal defense lawyer David P. Schwarz will present a compelling case on your behalf.
